1. Acceptance of Terms
By registering for or using Nexus Connect ("Nexus Connect," "we," "our," or "us") — including our website at nexusconnect.live and any related school system pages — you ("User," "School," or "Administrator") agree to these Terms of Service. If you don't agree, please stop using the platform.
2. Account Security & Restricted Access
Administrator accounts (created through Clerk) are for recognized school staff, teachers, or student administrators working with campus approval. Administrators are responsible for keeping their login credentials — usernames, passwords, and sign-in links — secure.
Administrators may not share their admin login or admin access links with the general student body. If an administrator's account is compromised because login details weren't kept secure, the School is responsible for anything that happens as a result.
3. Event Data: Saving, Discarding, and Retention
Nexus Connect processes event data live, at the edge, while an event is running. When an event ends, the school administrator chooses whether to save or discard that event's data (temporary leaderboards, scores, and randomly generated usernames).
- If you don't save it: If the administrator chooses not to save the event, or closes the session without saving, all of that event's data is immediately and permanently deleted from our systems. We have no way to recover data from an unsaved or discarded session — once it's gone, it's gone.
- If you save it: If the administrator chooses to save the event, the data is stored in the school's private admin dashboard, where it can be reviewed, exported as a CSV, or deleted at any time.
It's the school administrator's responsibility to decide whether to save each session. Nexus Connect isn't liable for lost results, leaderboards, or participation data if an administrator doesn't save a completed session.
4. User-Generated Content & Staff Consent
When your School uploads images, photos, or other files into Nexus Connect (for example, for Mascot Hunt, Yearbook, or Name Game), the School confirms that:
- The School has the legal right to use and display those files.
- The files don't infringe anyone's copyright, trademark, or personal likeness rights.
- For faculty and staff photos specifically: the School has gotten clear, informed permission from any staff member, teacher, or community member whose photo is used in a guessing game.
Nexus Connect hosts this content on your School's behalf — the School owns and remains responsible for the content it uploads, and we don't claim ownership over it. We're not obligated to review uploaded files, but we reserve the right to remove anything we determine is inappropriate, unsafe, or against reasonable school standards, at any time and without notice.
The School agrees to defend and cover Nexus Connect against any legal claims, damages, or costs that come from a violation of this section — for example, if uploaded content turns out to infringe someone's rights.
5. Billing, Subscriptions, and Invoicing
Subscriptions are billed through Stripe Checkout. By confirming a paid plan, you authorize Nexus Connect (via Stripe) to charge your subscription fee annually, unless you cancel or change your plan before your renewal date.
Schools using manual invoicing are billed through the same Stripe system. Invoices are due within thirty (30) days of the invoice date, unless we've agreed to different terms in writing. If an invoice is significantly overdue, we may pause your account or restrict dashboard access until it's resolved. All payments are non-refundable except where required by law.
Email Sign-In Add-On. The optional Email Sign-In feature (see Section 2 of our Privacy Policy) is billed separately from your base subscription as the "Nexus Connect SSO Add-On," at ten dollars ($10) per year, renewing annually through the same Stripe billing system until cancelled. This add-on can be added or removed independently of your base plan. Enabling the add-on doesn't automatically turn on Email Sign-In for your students — we also need to configure the feature for your school, as described in our Privacy Policy.
6. Fair Use & Anti-Tampering Rules
Users (including student participants) may not attempt to break, cheat, or manipulate our games. You agree not to build or use bots, scripts, automation tools, or scoring exploits to fake responses in interactive games like Mascot Hunt.
Intercepting, spoofing, or faking live network connections, APIs, or application endpoints tied to *.nexusconnect.live will result in an immediate, permanent ban.
Because student participants are, by default, anonymous and identified only by temporary auto-generated usernames, we can't remove or isolate individual usernames mid-session. (For schools that have separately enabled the optional Email Sign-In add-on described in Section 5, a student's participation is instead tied to their verified school account — but the same limit applies: individual participants still can't be isolated or removed mid-session through the app.) If a live session or leaderboard is disrupted by tampering or bad-faith activity, the administrator's only option within the app is to reset or restart the session. Nexus Connect isn't liable for disruptions caused by leaderboard tampering or the resulting need to reset a session.
7. Governing Law and Severability
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. If any part of these Terms is found unenforceable by a court, that part will be adjusted to reflect its intent as closely as possible, and the rest of these Terms will remain in full effect.
